If he never filed an immigrant visa petition for her after marrying her, she will have to leave, as she can't adjust status in the US even if the two of you get married and you do file the proper paperwork. If she has a conditional green card, it will depend on whether she was married long enough to qualify for permanent resident status even after the divorce.

It really will depend on how long she was here after she married and whether or not husband #1 filed immigration papers for her or not. These girls want to stay and will give you some really great mattress to convince you to marry them. I promise you once they hit the magic 2 year mark they will be gone taking your money and sanity with them. They know how to play the system and I have seen girls with 3-4 k1 visas in their passport already. I have spoken to many guys who begged me to tell them what to do because many of these girls will wait 2 years and then go to a lawyer for a divorce claiming their husbands beat them. They are trying to exploit the loophole that lets them stay if that happens. These guys get arrested on nothing more than the false complaint of these shady women and their lives get really screwed up. They lose their jobs and houses and go broke trying to fight these false charges. If you meet a girl and she already has 1 k-1 visa in her passport it means she tried once and failed and now needs another sucker. She does not love you she loves being here and you are just her ticket to get what she wants. It's still amazes me when I see these drop dead gorgeous 21 year old girls coming over with their 50 y/o overweight American fiances. I know the big time hurting these girls are gonna put on these poor bastards but nothing I can do about it. These guys should open their eyes and take a good look in the mirror but I guess it is the downfall of all us men that a great piece of tail clouds everyones good judgement. If she is that hot then take her for a test drive but do not under any condition put your name on the dotted line.

The best thing I can tell you is to run from this girl. She will not be eligible for it after the divorce so she has to go back. They only make exceptions when you have a 2-year conditional card and you can prove that you got married with good intentions but the marriage did not turn out well (for example the citizen spouse battered you or cheated on you). If this is not the case, she will have to go back to her country. If she doesn't, she will be considered an illegal. If you want to keep her in the U.S., she should apply for another kind of visa from her country (tourist, working, student...etc). She won't get denied because of the K-1 visa she holds unless she stays in the U.S. illegally. If she overstays, she will get a 10-year ban and during that time she will never be allowed to return to the U.S.

She will be sent back to her country since she does not even have her GC yet.
